Builders cannot charges Transfer fees By Staff Reporter
Many builders in Maharashtra are charging Transfer fees to hand over flats to a purchasers. Although the builders, who is supposed to give conveyance (right to own a land on which the society’s building is existing) to the society, and is not, at all concerned with the society affair, charges the name Transfer fees for the purchaser. At the item of agreement, many builders promise to form a Co-operative Housing Society and should bear the cost of the formation. Inspite of that they charge Transfer the flat in his income. Where as, the builders do not get any right to collect the Transfer fee, since it is a matter of the concerned of the society and not the builders. If the builders or his representative is a member of the society and own the right to own a flat, which he is selling to the purchasers, charges Transfer fees in his individual capacity will lead to ultra virus transaction and not according to any law for the time being in force. Since he do not own society neither the affairs of the society is his concern. Many builders charge Transfer fee from purchasers in cash and do not give cash receipts. They also charge ten to fifteen thousand for electricity Meters, which the purchasers would have got for mere two to three thousand. The practice to charge such baseless cause is fundamentals phenomena now. Poor flat purchaser has to give up all his money just to get his keys for his sweet home.
