The procedure for transfer of MHADA Societies is simple . You would be surprised to know that MHADA authorities transfer the flats even if the NOC is not obtained from the Society . Suppose the name of A is in MHADA’s record and the flat has been sold to B. Thereafter B sells the flat to C. In society’s record A is the member. In such cases MHADA authorities can transfer the flat in the name of C even if the flat has not been transferred in B’s name in the records of the society. However society must in our opinion ensure that all transfer formalities between A and B and From B to C are complied with by the parties.





















Hi, I am planning to purchase a property which is on Mhada’s land. The society registered under MCS act 1960. Soceity is taken this land on lease for 90 yrs. After constructing the building society gave an allotement letter to the new members and issued the share ceritificare. Now when i am trying to purchase this property the banks are saying they want the NOC from Mhada. is it right? As society registerd under 1960 act and later on the model bye laws were published and society being old they are not following it. Neither my seller has paid the transfer fee to mhada nor he has any letter of allotment from mhada. So why banks are asking NOC from mhada.? What do I need to do to make this deal happen?

We have bought a house at Mhada society. It is resale. A is the owner of the house. We have obtained the possession of the house, payment receipts from the builder. But we have not yet received the ownership papers, (sale deed…………ETC). The builder and other people of hte society responsible for transfer of documents are giving one excuse or the other. Please tell me what all documents are required so that we can be the legal owner of the house as i am not aware of the mHADA FORMALITIES.

B is the second buyer. and i m the third one. i.e C.
i bought the flat from B. In the mhada’s record, still A is the owner. B has not done mhada transfer nor me. i have put up my file with all legal doc. to mhada through agent for mhada transfer. but i heard that nowdays mhada has stop the transfer procedure and they will be giving this authourity to the sociaty itself. can u plz update me on that.

even i m facing the same problem, i have done an application in mhada but getting the NOC is difficult, and bank needs the NOC for loan, i have applied in other banks also where my agent says we wont need the NOC, but i m not sure if other banks will no need the NOC…. is there anyone who has got the NOC or LOAN from banks with the redeveloped projects on Mhada land… please help me.

I am purchasing a resale flat at gorai 1. the building got its CC in 1998 & the land is on 99 years lease. I was told by my broker that the Mhada transfer fee has been scraped around 2 years back & Mr. Sanjay nirupam was the one who fought for it to happen. I now got the registration also done & my bank is now demanding for Mhada NOC. My broker says transfer rights r been given to the society & mhada wont issue any NOC now. Can any one help me on this. i am secretory. in the soceity. one of the member ‘A’ is selling a shop to “B” who has already 2 shops. is there any problem in giving ‘NOC’ to member ’A’ to sell the shop to member “B”
i bought a mhada flat which was alloted to a slum dweller.i bought it by affidavit and power of attorney system of way.can be this flat transfer to my name by mhada?
