“Deemed Conveyance is like Deemed Marriage”

“It takes no time for the government to issue notification regularizing the slums or extending the date of regularization, but it takes years to issue similar order on conveyance” said Justice R J Kochar, former judge of the Bombay High Court. He was delivering the keynote address at the seminar on deemed conveyance and redevelopment, organized by the Accommodation Times in association with Revathi Memorial Foundation, and sponsored by Aura Realty.

Dwelling on conveyance issues Justice Kochar said that the orders on deemed conveyance appears to be like deemed marriage. “After having purchased a flat and meeting all the formalities required from the Housing Societies Act, the flat purchasers and the housing societies wait for the conveyance from the landlords/developers and the government treats this issue as deemed conveyance and if the developer fails to convey, it is in the same way, after having marriage, and birth of child and later can this be treated as deemed marriage?” he asked.

Justice Kochar suggested that with the number of conveyance cases to be attended by Competent Authority, senior advocates and professionals of the bar should also be considered for appointment as competent authority to deal with conveyance matters. More than 80% of the housing societies in the city of Mumbai have not got their conveyance from the builders and one single authority will not be able to dispose of the matters speedily and hence the government should appoint more officers to handle such cases, he added.

Mr. Gopal Shetty, the local MLA in his address assured the participants that he is ready to help those who need his help in such matters, while thanking the voters for their confidence in him and asked Revathi Foundation to spread this movement to spread awareness.

Mr. Sridhar Sharma, Chairman, Revathi Memorial Foundation made an effective power point presentation on the salient features of conveyance and deemed conveyance. He gave details on the requirements that needed compilation by flat purchasers.

Mr. Yeshwant Gujaran, structural engineer highlighted the technical aspects of redevelopment while the legal aspects were substantiated by Advocate Shreepad Murthy. On the subject of taxation, stamp duty, registration, Advocate R. Subramanian dwelt at length how to save tax burden on the society/members.
Finally question and answer session was held with the panel that included Sanjeev Kanchan, Advocate, Mr. Sadanand Rane, Rtd. Dy. Chief Engineer, BMC, Mr. Sridhar Sharma, Mr. Yashwant Gujaran, Adv. Subramanian and others.

Ajay Chaturvedi, CEO of Accommodation Times, welcomed and also thanked the speakers and guests for their presence at the seminar. With the over whelming response from the society office bearers and flat owners, the organizers have decided to convene such seminars regularly for the benefit of flat owners, purchasers, shopkeepers, industrial and commercial premises owners. Traffic came to a standstill on Sunday morning when 800 people gathered outside Madhuram party hall to attend the housing society seminar and guidance camp.
