Consumer Redressal Commission penalize Rs.1.5L to builder for delay

Commission has ordered to builder to take some robust actions for the formation and registration of a co-operative housing society of flat purchasers in Lok Everest in Mulund West

The Maharashtra State Consumer Disputes Redressal Commission recently has taken a harsh move on builder for delay in handing over a constructed flat, without copies of Intimation of Disapproval, Completion Certificate and Occupancy Certificate, amount to clear cut deficiency in service on part of the developer.
The Consumer Commission has ordered to Lok Housing and Constructions Ltd. to pay one lakh rupees compensation to flat owner named B S Shetty, as builder has delayed to hand over possession of two flats for nine months after the promised date, without copies of the three certificates issued by the Brihan Mumbai Municipal Corporation (BMC). Apart from this builder will also have to pay Rs.50000 as Shetty has spent on court fees.
According to the commission’s observation “The developer has accepted that they are incompetent to provide service by not complying with their contractual and statutory obligations.” More on this commission has ordered to builder to take some robust actions for the formation and registration of a co-operative housing society of flat purchasers in Lok Everest in Mulund West and to execute and register conveyance in favour of the society. Whereas Shetty has reserved two flats in Lok Everest in June 1996 for Rs. 8.76Lakh, in return builder has issued a letter to him and mentioned in that construction company will provide possession in September 1998.
Whereas according to the sales agreement was executed in August 2005 after nine years, and the developer agreed to handover possession of ready flats by March 2006.
But, the complainant got the possession only in December 2006, without electricity supply and municipal water connection.
