Govt can’t acquire pvt land unless genuine need: SC

New Delhi:
The Supreme Court recently has issued an order to government that “government can not take over private land unless there is a genuine need that can’t brook delay.”
“The call of urgent basis is acceptable only in case when there is indeed emergency that cannot brook delay of even a few weeks or months,” Supreme Court added. According to the justice bench comprising GS Singhvi and SJ Mukhopadhaya that if government unable to justify the genuine reasons of acquiring land, it would amount to depriving the citizen of his fundamental rights guaranteed under the Constitution.
The Supreme Court has passed the judgement following to the Delhi government’s acquisition of private lands of Darshan Lal Nagpal and others at Mandoli village for implant electric substation by Delhi Transco Limited.
