HC deters construction over Colaba mill land

The Bombay High court on Monday while hearing the petition filed by Mukesh Mills for constructing building at Colaba, said that country’s safety is prime concern. The verdict has brought a big triumph for Indian Navy which opposed it as the plot is bang next to its base INS Shikara, sharing a mere compound wall.
The Division benches of justices have heard the petition which has been filed by the TCI Industries Limited challenging the September 22, 2006 refusal of sanction by the BMC to develop the property and insisting on an NOC from the ministry of defence.
The judges said that “planning authorities must have to keen while approving such projects have to kept pros and cons in the mind.” They added that “the security aspect should be left to defence authorities as it is their realm and is not for the court to decide.”
