HC turned furious on delinquent builders

On 31st March all the municipal corporations of state has been directed by the Bombay High court that publish the names of those developers in the local newspaper who have sought permission for their unauthorized buildings.
While hearing to PIL filed by the social activist Rjendra Thacker (division bench headed by chief justice Mohit Shah and justice DG Karnik)citing that almost builders distributing misguided prospectus to the flat seekers. Activist also alleged in the PIL that several developers are showing facilities in the prospectus for representational purpose only, which is written in a very fine line in the prospectus.
Advocate Sumedha Roa argued in HC for petitioner, that some builders are constructing buildings in violations of rules and when they got notice from the corporation to stop then developers show willingness to pay penalty.
PIL includes the example of Lodha builders that, as per petition Lodha builders has distributed prospectus on 12th March for forthcoming project at Dahisar named “Lodha Aqua.” Prospectus illustrates beautiful waterfalls, individual pools with decks, lush-green podium, a grand clubhouse spread across 10,000 sq ft with a gym, pool, café, full-sized cricket pitch, badminton and basketball court, Jacuzzi and more.
The PIL affirmed, “On perusing the brochure, the petitioner was shocked to read in small print at the bottom: ‘In select Residences. Images for representative purpose only. Conditions apply’. The brochure announces a discount of up to Rs7.5 lakh between March 7 and April 4.” The brochure also stated that possession has commenced. However, the PIL contends, that there was no mention of issuance of an occupation certificate for the buildings.
PIL pleaded that entire civic bodies be directed to publish the names of defaulters name in the local media for violations of rules. It stated that Lodha builders should be restrained from giving possession without getting an OC for Lodha Aqua. It also sought inquiry into the 26 unauthorized towers of Casa Univis and concerned officers be held guilty for incompetent to stop the same at appropriate time.
